Agreement

James T. Randall (d.b.a 2Be Photography) 

1.  This agreement constitutes an order for wedding portraiture services, including taking of wedding pictures as agreed to by both parties: James T. Randall d.b.a. 2Be Photography (Photographer), and the contracting party (Client). Client will receive pictures on DVD for their use to reprint photos at their discretion.  No copyright image will appear on the photo.  Photographer retains the right to use the photo's on his website or otherwise to advertise his services.

2.  If the Client fails to make whatever payments are required under this agreement, then all obligations of Photographer shall cease without any further obligations.

3.  In the unlikely event that the photographer is injured or becomes too ill to photograph the event, Photographer will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. There shall be no liability on behalf of Photographer, its employees, agents, assigns or licensees for their nonperformance caused by any force of nature or similar circumstances, illness, accident or any cause beyond their control; nor for the loss or damage of any photographic materials, whether in transit or in developing. In any event, the limit of 2BePhotography liability shall not exceed the contract price stated herein.

4.  Friends and relatives are welcome to take pictures if desired by Client.  However, it is recommended by Photographer that friends and relatives take pictures after the formal pictures taken by Photographer so as not to interfere with posing. 

5.  There shall be no refunds of deposits or retainers if the event is canceled. The balance due shall be paid weeks prior to the wedding.

6.  Due to the uncontrollable nature of wedding logistics, photographing requests may be impossible. The photographic services as described only include the services of photographer for the stated period of time.  Photographic services do not includes any promise, expectation, warranty or guarantee that any specific moment, action, event or person will be photographed in any way other than the sole judgment of the Photographer.  Photographer's judgment, selection and portrayal of the time period selected by the Client will be deemed complete by this contract.  Special requests for certain images although attempted by Photographer carry no guarantee, express or implied, that the resulting image will be satisfactory to Client.  Client waives all right to pass judgment on the service performed due to content, style, light, lighting, contrast, and other elements generally refereed to as content.  Requests by Client to convert color images to B&W will be at no charge.

7.  The aspect ratio of photo's is 2 to 3.  The standard print is 4x6.  Enlargements greater than 4x6 must be cropped to fit the desired size. Enlargements can alternatively be enlarged to 8x12 or 12x18, which does not require cropping, in lieu of 8x10 or 11x14 without cropping.  Client agrees that selecting enlargements of 5x7, 8x10, and 11x14 will require cropping which will be made at the photographers discretion.  Clients may choose enlargement ratios of 2 to 3 by contacting photographer with this desire prior to placing photo order.

8.  Coverage plan times must be used consecutively.  Time starts at the agreed starting time and ends when the coverage time runs out.

9.  Any changes to this plan must be in writing and signed by both parties.

10.  Additional photography hours beyond the contracted amount are billable at $125 per hour for the Silver and Gold Packages and $200 per hour for the four hour Bronze Package.

11.  On signing of this agreement by both parties hereto, and a retainer submitted to Photographer in the amount of $195 plus tax, Photographer will reserve the date agreed upon and will not make another reservation for the specific time frame. The deposit is applied toward the package price.   The client may print this contract, sign it, and mail to Photographer at 468 CR 3690 Boyd, TX 76023 or electronically "sign" this contract by clicking the "Yes" radial button below and emailing the contract where the Photographer shall also electronically sign the contract and return to Client by email.
